Intellectual Property Policy

It is the policy of Property Room, Inc. (“Property Room”) to respect the intellectual property rights of others. Such policy applies to the content and materials posted as a listing on the Property Room™ website (the "Website").

In addition, it is the policy of Property Room to prohibit the sale or offering for sale through the Website of any items that are illegal or hazardous or infringe upon any patent, trademark, copyright, or other intellectual property right (arising under the laws of any jurisdiction) or other proprietary right of any third party (“Prohibited Products”), including but not limited to explosives, firearms, poisons, pharmaceuticals, counterfeit or unauthorized copyrighted material (“knock-offs”), unauthorized replicas (such as counterfeit watches, handbags, clothing or accessories) or pirated copies (such as copies of software, video games, music, movies, TV programs, or photos).

The Website is primarily a venue for law enforcement agencies and other government agencies to conduct auctions and bidders to bid on auctions. Accordingly, items sold through the Website include items that may have been seized, forfeited, or found by law enforcement agencies. Unless otherwise expressly stated by Property Room, Property Room is involved only as a facilitator and/or agent in the transaction between buyers and sellers using the Website. As a result Property Room cannot control all content and materials posted as a listing on the Website or all items put up for auction by sellers through the Website. Therefore, Property Room has adopted the procedures set forth below to allow third parties to bring to its attention for correction any infringement by listings and/or offering of Prohibited Products through the Website.

Removal of Infringing Content in a Listing

If you believe that the content (including the photographs, text or other material) of any listing on the Website infringes your rights in any copyright or other intellectual property right, please provide Property Room’s Copyright Agent the following information:

  1. A description of where the material that you claim is infringing is located on the Website (with the Listing ID, if you are claiming infringement occurs in a listing);
  2. A description of the copyrighted work or other intellectual property right that you claim has been infringed;
  3. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property right;
  4. Your address, telephone number, and email address;
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner (or intellectual property right owner, as applicable), its agent, or the law;
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the owner of the copyright or other intellectual property right or authorized to act on the behalf of the owner of the copyright or intellectual property right.

Removal of Auctions for Prohibited Products

If you believe that any item identified in a listing on the Website is a Prohibited Product because it infringes any of your intellectual property rights, please provide Property Room’s Compliance Agent the following information:

  1. A description of the item and identification of its Item Number;
  2. A description of the intellectual property right that you claim has been infringed, with identification of the specific copyrighted work(s), patent(s), trademark(s) or other intellectual property right that you claim has been infringed. If you claim that the infringement is of one or more patents, registered copyrights or registered trademarks, you must identify the jurisdiction in which each such patent or registration exists and provide the applicable patent or registration number;
  3. Your address, telephone number, and email address;
  4. A statement by you that you have a good faith belief that the disputed use is not authorized by the intellectual property right owner, its agent, or the law;
  5. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the owner of the copyright or other intellectual property right or authorized to act on the behalf of the owner of the copyright or intellectual property right; and
  6. An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property right.

If you believe that any item identified in a listing on the Website is a Prohibited Product on any basis other than infringement of your intellectual property right, please provide PropertyRoom’s Compliance Agent the following information:

  1. A description of the item and identification of its Item Number;
  2. A description of the basis upon which you believe the item is a Prohibited Product.
  3. Your address, telephone number, and email address;
  4. A statement by you that you have a good faith belief that the item is a Prohibited Product.
  5. A statement by you, made under penalty of perjury, that the above information in your notice is accurate; and
  6. An electronic or physical signature of the person submitting the notice.
